Re: Carpet Installation

Dear Sir or Madam,

On November 17, 2005 I signed a contract with your company to have wall-to-wall carpeting installed in my home. The agreement stipulated in Paragraph 2(b) that the job would be completed by December 23, 2005.

You assured me that there was plenty of time to order the carpets I had selected and that the job would be completed by the aforementioned date. 

In the enclosed copy of our contract it is clearly stated that the job must be completed by the Christmas holidays as I was having family over for Christmas dinner. 

Your company did not commence installation until December 3, 2005, and the job was not finished until January 9, 2005. I visited your showroom at 353 Washington Way several times to inquire about the lack of progress, but received an indifferent attitude from your salesperson who sold us the carpet – Jerry Swan.

The incomplete job was major inconvenience to our holiday celebrations, my family had to constantly watch their step so as to avoid the many off-cuts and rolls of uninstalled carpet throughout the house. We could not use the living room at all because of the bare concrete floor and furniture piled up in the middle of the room.

I believe that as per Paragraph 7 (c) we should be reimbursed a total of $395.00 – the 25% penalty for failing to complete the job as per the contract.
